This privacy notice explains how Practina (AI tool) collects, uses, processes, discloses, retains, and protects personal information i) when we provide services to you; and ii) when we process personal information at your instruction that may be included as part of the Content that you view, upload, download or otherwise appears on our mobile applications (Android and iOS).

Your use of the AI tool, i.e. Practina signifies your consent to the collection and utilization of information as described in this Privacy Policy.

The term "Practina," "us," "we," or "our" in this privacy policy notice pertains to Practina Inc. The terms "you" and “its” designate businesses that opt to utilize Practina for marketing their services/products across various digital platforms.

Our Services

Practina offers a suite of digital marketing services. Our mobile applications allow you to connect your Twitter, Facebook, Instagram, Yelp, and Google My Business accounts(s) for easy promotion of your services and products. Practina helps its users generate, manage, track, schedule, and post different forms of Content. By associating your current social media, Yelp, and account(s) with your Practina account, you can choose to promptly generate, manage, and distribute Content through your Practina account.

Personal Information We Collect

Personal information is information related to an identified or identifiable natural person. An identifiable natural person is an individual that can be identified, directly or indirectly, by reference to an identifier such as a name, an identification number, specific location data, an online identifier, or other attributes specific to that natural person.

Personal information does not include information that has been anonymized or aggregated in such a way that it can no longer be used to identify a specific natural person, whether on its own or in combination with other information.

The personal information that we collect falls into two broad categories: Account(s) Data and Content.

Account Data

Account data (“Account Data”) is personal information you provide us, or that we collect from you and your devices in connection with your access to and use of our mobile applications (such as when you provide us information to register for an account, etc.). In legal terms, we collect and use this Account Data as a data controller.

There are two general categories of Account Data we collect to provide you with the Services.

1. Information you give us

Personal Information: You may provide us with information in connection with the creation and management of your account for the Services, such as a name, email address, and password to create a Practina account.

Business information: You may provide us with business information such as a name, a logo, an industry, a contact number, an email address, a website URL, and a physical address so that you can receive best-suggested content (social media posts, ad creatives, blogs, review templates, ad copies) from Practina

Other information: You may otherwise choose to provide us with information when you link your Social Network profiles with your Practina profile.

2. Information we automatically collect from your use of the Services

Log data and usage information:We want to inform you that whenever you use our Service, in the case of an error in the app we collect data and information (through third-party services) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Content

The content that you upload, download, or view on our mobile apps (defined as “Content” in our Terms) may, but does not necessarily, contain personal information. When we refer to “Content” in this notice, we mean the personal information in the Content that we process. We only process Content at your direction. In legal terms, we act as data processors for the personal information included in the Content. Our obligations and commitments as they relate to our processing of Content on behalf of our users are outlined in the section below called Content - Practina as a Data Processor.

Account Data - How We Use It

We use, store, and process Account Data as a data controller to provide, understand, and improve our apps and to comply with our legal obligations. More particularly, we use it to:

Identify Our Users

We use Account Data to identify you when you log in to your account.

Provide Services

We use Account Data to enable us to operate the Services and provide them to you, including:

  • Enable your access to our Services
  • Contact you about your account and provide customer service support, including responding to your comments and questions
  • Keep you informed about the features, surveys, newsletters, offers, contests, and events we think you may find useful or that you have requested from us
  • Market Practina services to you

Improve And Optimize

We use Account Data To

  • Better understand your needs and the needs of users in the aggregate, diagnose problems, analyze trends, perform analytics, conduct research and improve the features and usability of the Services, test and troubleshoot new products and better understand and market to our users.
  • Analyze the Website or other services and information about our visitors and users, including research into our user demographics and user behavior Create aggregate (non-identifiable) statistics about users of the Services with a view to introducing improvements and improving the usability of the Services.

Keep our Services safe.

We use Account Data to verify accounts and activity, maintain the integrity of our Services, and keep mobile apps safe and secure.

Content- Practina as a Data Processor

You, as a Practina user, control how Content is generated, requested, submitted, or published, and processed on our mobile applications. When you use our mobile apps, you may view, create, and analyze Content that will ultimately be published on various Social Networks and digital platforms. You can also choose to access and/or link your Practina account to a wide range of Third-Party Apps. When you link these Third-Party Apps to your Practina account, you allow those Third-Party apps to access and process Content. The Content that flows through our mobile apps may include personal information of all types, including but not limited to the following categories:

  • User-generated content (such as posts, comments, pages, profiles, images, feeds, or communications exchanged on Social Networks).
  • Contact details (such as name, email address, telephone number)
  • Additional individual information (such as age, gender, employer, profession, geographic location, education information, financial status, habits, and preferences).
  • Information relating to an individual's real-time location.

As the user, you are the data controller of your Content and we are the data processor for such Content. When we process Content, we do so at your direction and on your behalf per the instructions you give us through the mobile apps. When you connect your social media accounts through our mobile apps, we only access, process, and use the Content to provide our services subject to the Terms and the various terms and conditions imposed by the Social Networks. We may, in limited circumstances process Content to improve the mobile apps and functionalities users ask for as part of their Practina experience

Social Networks

The Practina mobile apps enable an ecosystem where you can choose to connect your Practina account with Social Networks. If you choose to send your Content to a Social Network, Practina is no longer responsible for that Content from the point in time that it leaves Practina's mobile apps. For example, if you use Practina to post a tweet on Twitter, Twitter's privacy policy and terms of service will apply to that tweet on Twitter's server. We encourage you to carefully review the privacy policies of any Social Networks you access via our mobile apps.

Access, correction, and deletion of Content

You should be aware that Practina acts as a conduit between you and the various Social Networks. In several instances, the Content published via Practina will not be in Practina's custody, and any Content that has been shared by you through any Social Networks via mobile apps may continue to be available to third parties and the public at large, as this Content is now under the control of the operators of the Social Networks.

Practina (“we” or “us” or “our”) may use cookies, web beacons, tracking pixels, and other tracking technologies when you visit our website www.practina.com, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”) to help customize the Site and improve your experience.

Any changes or modifications will be effective immediately upon posting the updated Cookie Policy on the Site, and you waive the right to receive specific notice of each such change or modification

Data Retention

How long we keep the personal information we collect depends on the type of information, the purpose for which it is used, how sensitive it is, and similar factors. In general, we will retain your personal information for the length of time reasonably needed to fulfill the purposes outlined in this privacy policy (including for as long as needed to provide you or our customer with products and services), unless a longer retention period is required or permitted by law. We will also retain and use your information for as long as necessary to resolve disputes and/or enforce our rights and agreements. We retain your account information for the Practina Services for as long as your account is active and thereafter unless you request deletion. Anonymous and aggregated information may be stored indefinitely.

Child Safety

Zero-Tolerance for Child Sexual Abuse and Exploitation (CSAE)

  • Prohibition of Harmful Content: We have zero tolerance for any form of Child Sexual Abuse Material (CSAM) or content that depicts, promotes, or glorifies the sexual exploitation or abuse of minors.
  • User Responsibility: By using our Services, you agree to refrain from uploading, sharing, or otherwise disseminating content that violates this policy.

Reporting & In-App Feedback Mechanism

  • Reporting Tools: If you encounter any content or user behavior that you believe violates this Child Safety section, please report it immediately through the in-app reporting feature or by contacting us at support@practina.com.
  • Response & Investigation: We promptly review all credible reports and take appropriate enforcement measures, including, but not limited to, content removal, user account suspension or termination, and notifying relevant authorities.

Removal of CSAM

  • Immediate Action: Upon obtaining actual knowledge of CSAM on our platform, we will promptly remove and block access to such content.
  • Additional Steps: Users responsible for posting or sharing CSAM will face immediate account termination, and we will cooperate with law enforcement agencies where required by law.

Compliance with Child Safety Laws

  • Mandatory Reporting: We comply with all applicable child protection laws and regulations in the jurisdictions where we operate. If required, we will report confirmed instances of CSAM to the National Center for Missing and Exploited Children (NCMEC) in the United States, or other relevant regional authorities.
  • Legal Cooperation: We will cooperate with law enforcement or child protection agencies in investigations relating to child exploitation and abuse.

Consistent with California law, if you choose to exercise your rights, you will not receive discriminatory treatment by Practina.

Under certain circumstances, you may designate an authorized agent to request on your behalf. To designate an authorized agent to request on your behalf, you must provide a valid power of attorney, your valid government-issued identification, and the authorized agent's valid government-issued identification to allow Practina to verify that the agent is authorized to request on your behalf.
